The Assam cabinet<\/a> approved the Assam<\/a> Compulsory Registration<\/a> of Muslim Marriage and Divorce Bill, 2024, mandating Muslims to register marriages and divorces<\/a> with the government<\/a>. This will eliminate the role of \u201cqazis\u201d in this process, and aims to curb child marriages.<\/p>\n

The proposed law<\/a> will be presented in the legislative assembly during the autumn session beginning Thursday. Assam Chief Minister Himanta Biswa Sarma<\/a> shared on social media platform X, “Today the Assam Cabinet has approved the Muslim Marriage Registration Bill 2024. It has two special provisions: Now the registration of Muslim marriages<\/a> will be done by the government and not by the Qazi\u201d and \u201cregistration of child marriage<\/a> shall be deemed illegal.”<\/p>\n

District commissioners and registrars will be responsible for keeping the registration records, which are currently held by 94 qazis authorized under a British-era law from 1935. The new bill intends to prevent the registration of marriages involving minors, something that was previously handled by the qazis.<\/p>\n

“Marriages of minors were also registered by the qazis. Now, child marriage registration will not happen at all. We want to end the menace of child marriage,” CM Sarma stated. He clarified that the new law does not alter the traditional Islamic marriage system, but only changes the registration process. “Only change will be the registration part. Marriages and divorces will be registered at the sub-register\u2019s office,” reported TOI quoting him. <\/p>\n

In July, the Assam cabinet had already approved the repeal of the Assam Muslim Marriages and Divorces Registration Act, 1935, to make way for the proposed compulsory registration law. A government official highlighted the outdated nature of the 1935 law, noting that it didn\u2019t enforce mandatory registration of marriages and divorces, leaving wide gaps for non-compliance.<\/p>\n

“As per provisions of this old act, there remains a scope for registering marriages of males below 21 years and females below 18 years, encouraging child marriages and there is hardly any monitoring for implementation of the law,” the official mentioned.The India Child Protection report released in July praised Assam\u2019s efforts to combat child marriages. The report noted a significant reduction in child marriage instances, with an 81% decrease across 20 districts in the state between 2021-22 and 2023-24.<\/p>\n
