{"id":121262,"date":"2024-08-25T18:11:04","date_gmt":"2024-08-25T18:11:04","guid":{"rendered":"https:\/\/news.talkwithrattan.com\/index.php\/2024\/08\/25\/interest-income-from-grants-must-be-credited-back-to-fcra-account-mha\/"},"modified":"2024-08-25T18:11:04","modified_gmt":"2024-08-25T18:11:04","slug":"interest-income-from-grants-must-be-credited-back-to-fcra-account-mha","status":"publish","type":"post","link":"https:\/\/news.talkwithrattan.com\/index.php\/2024\/08\/25\/interest-income-from-grants-must-be-credited-back-to-fcra-account-mha\/","title":{"rendered":"Interest, income from grants must be credited back to FCRA account: MHA"},"content":{"rendered":"<div style=\"text-align:center\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"900\" src=\"https:\/\/i2.wp.com\/img.etimg.com\/photo\/msid-112786924,imgsize-26388.cms?resize=1200,900&amp;ssl=1\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"Interest, income from grants must be credited back to FCRA account: MHA\" title=\"Interest, income from grants must be credited back to FCRA account: MHA\" \/><\/div>\n<div data-brcount=\"10\">The Ministry of Home Affairs (MHA), in a recent communication, has observed that the <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/interest-earned\" target=\"_blank\" rel=\"noopener\">interest earned<\/a> on <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/fixed-deposits\" target=\"_blank\" rel=\"noopener\">fixed deposits<\/a> (FDs) or profits made from investments in <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/financial-instruments\" target=\"_blank\" rel=\"noopener\">financial instruments<\/a> by non-governmental organisations (NGOs) using <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/foreign-funding\" target=\"_blank\" rel=\"noopener\">foreign funding<\/a> should be credited back to only <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/fcra\" target=\"_blank\" rel=\"noopener\">FCRA<\/a> utilisation accounts and not transferred to any other bank account.<\/p>\n<p><!--\/article_liveblog.cms?msid=105115637&pos=toppotime:1-->While reiterating section 2 (1) (h) of the FCRA Act, 2010, the communication, sent earlier this month, reviewed by ET, notes, &#8220;Attention has also been drawn to the provision of section 2 (1) (h) which states that any kind of income or interest or income that is derived from foreign contribution or interest earned becomes part of foreign contribution. Therefore, it will be credited back into the foreign contribution account to be utilised strictly as per the provision of the FCRA, 2010.&#8221;<\/p>\n<p>Further, the letter stated that, &#8220;&#8230;It can be concluded that the fixed deposits created or <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" target=\"_blank\" href=\"https:\/\/economictimes.indiatimes.com\/wealth\/invest\" rel=\"noopener\">investment<\/a> in financial instruments out of foreign contribution in FCRA utilisation account, on maturity or returns of such investment shall be credited into a FCRA utilisation account of the association maintained in any bank provided such investment made by the NGOs is not falling under the category of <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/speculative-activities\" target=\"_blank\" rel=\"noopener\">speculative activities<\/a> as defined under rule 4 of the Foreign Contribution (Regulation) Rules, 2011.&#8221;<\/p>\n<p>As per FCRA, 2011, a speculative is defined as any activity or investment that has an element of risk of appreciation or depreciation of the original investment, linked to market forces, including investment in mutual funds or in shares, participation in any scheme that promises high returns like investment in chits or land or similar assets not directly linked to the declared aims and objectives of the organisation or association. However, a debt-based secure investment shall not be treated as speculative investment.<\/p>\n<p>The rules also required every NGO to maintain a separate register of investments which can be submitted for audit before MHA.
