{"id":121685,"date":"2024-08-26T12:33:07","date_gmt":"2024-08-26T12:33:07","guid":{"rendered":"https:\/\/news.talkwithrattan.com\/index.php\/2024\/08\/26\/uber-dutch-watchdog-fines-app-246m-for-driver-data-transfer\/"},"modified":"2024-08-26T12:33:07","modified_gmt":"2024-08-26T12:33:07","slug":"uber-dutch-watchdog-fines-app-246m-for-driver-data-transfer","status":"publish","type":"post","link":"https:\/\/news.talkwithrattan.com\/index.php\/2024\/08\/26\/uber-dutch-watchdog-fines-app-246m-for-driver-data-transfer\/","title":{"rendered":"Uber: Dutch watchdog fines app \u00a3246m for driver data transfer"},"content":{"rendered":"<div style=\"text-align:center\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/i3.wp.com\/ichef.bbci.co.uk\/news\/1024\/branded_news\/f288\/live\/58ff3920-638b-11ef-966d-d350b1c7ad45.jpg?resize=1024,576&amp;ssl=1\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"Uber: Dutch watchdog fines app \u00a3246m for driver data transfer\" title=\"Uber: Dutch watchdog fines app \u00a3246m for driver data transfer\" \/><\/div><p> <br \/>\n<\/p>\n<div data-component=\"text-block\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The ride-hailing app Uber has been hit with a \u20ac290m (\u00a3246m; $324m) fine for transferring the personal data of European drivers to US servers in violation of EU rules, the Dutch data protection regulator said on Monday.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The Dutch Data Protection Authority (DPA) said the transfers were a &#8220;serious violation&#8221; of the EU&#8217;s General Data Protection Regulation (GDPR), as they failed to appropriately protect driver information.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">According to the watchdog, information including ID documents, taxi licences and location data was transferred to the company&#8217;s headquarters in the US over a two-year period.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Uber said it would appeal the fine, which it called &#8220;unjustified&#8221;.<!-- --><\/p>\n<\/div>\n<div data-component=\"text-block\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">&#8220;Uber&#8217;s cross-border data transfer process was compliant with GDPR during a 3-year period of immense uncertainty between the EU and US,\u201d an Uber spokesperson said.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">&#8220;This flawed decision and extraordinary fine are completely unjustified,&#8221; the statement added.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">While data transfers to the US are allowed under EU law, there is significant uncertainty around when the can occur without the need for further authorisation. <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">DPA chairman Aleid Wolfsen said the company failed to meet GDPR requirements to \u201censure the level of protection to the data with regard to transfers to the US.\u201d<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cThat is very serious,\u201d he added, noting that Uber also failed to appropriately safeguard the data.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The DPA said Uber collected sensitive information of European drivers, including taxi licences, location data, photos, payment details, identity documents, &#8220;and in some cases even criminal and medical data of drivers&#8221;.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">It said it started the investigation after more than 170 French drivers complained to a French human rights group, which then filed a complaint to France&#8217;s data protection watchdog.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Under GDPR rules, a business that processes data in several EU countries must deal with the data protection authority where its main office is located. Uber&#8217;s European headquarters are in the Netherlands.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">&#8220;In Europe, the GDPR protects the fundamental rights of people, by requiring businesses and governments to handle personal data with due care,&#8221; Mr Wolfsen said.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cThink of governments that can tap data on a large scale,\u201d he said, explaining, \u201cbusinesses are usually obliged to take additional measures if they store personal data of Europeans outside the European Union.&#8221;<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">It is the DPA&#8217;s third fine against Uber following fines of \u20ac600,000 (\u00a3508,000) in 2018 and \u20ac10m (\u00a38.5m) last year.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The EU has rolled out a series of rules for big tech firms and imposed huge fines for breaches in recent years.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Last year.
