In the meantime, a division bench comprising Chief Justice of India (CJI) D Y Chandrachud and Justice JB Pardiwala held that the Centre &#8220;may consider to bring about the suggested amendment to the POCSO by way of an ordinance.&#8221;<\/p>\n<p>In a significant judgment the bench ruled that merely watching and storage of pornography involving a child on <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/digital-devices\" target=\"_blank\" rel=\"noopener\">digital devices<\/a> can be an offence under the <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/protection-of-children-from-sexual-offences-act\" target=\"_blank\" rel=\"noopener\">Protection of Children from Sexual Offences Act<\/a>, 2012 (POCSO Act) if the person concerned had the intention to share or transmit the same or had the intention to make commercial gains using the same.<\/p>\n<p>The judgment reads &#8220;We are of the considered view, that wherever a person indulges in any activity such as viewing, distributing or displaying etc. pertaining to any child pornographic material without actually possessing or storing it in any device or in any form or manner, such act would still tantamount to &#8216;possession&#8217; in terms of Section 15 of the POCSO, if he exercised a variable degree of control over such material.&#8221;<\/p>\n<p>Setting aside a judgment passed by the <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/madras-high-court\" target=\"_blank\" rel=\"noopener\">Madras High Court<\/a> in this regard and calling the HC&#8217;s judgment an &#8220;egregious error,&#8221; the top court elaborated on the degree of mens rea (intention) required for such an act to constitute an offence under Section 15 of the POCSO Act.<\/p>\n<p><!--\/include_growfast.cms?pagename=article&skipcss=1potime:2--><br \/>The court also directed all the courts to not use the term &#8220;child pornography&#8221; in any of their judicial orders or judgment.
