Mehta contended how can a petition filed by an individual, who has been declared a fugitive by the court of law, be maintainable under Article 32?<\/p>\n<p>Naik has been booked in the states of Maharashtra and Karnataka under section 153A (<a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/promoting-enmity\" target=\"_blank\" rel=\"noopener\">promoting enmity<\/a> between different groups on ground of religion etc., and doing acts prejudicial to maintenance of harmony) of the IPC.<\/p>\n<p>A bench comprising Justices Abhay Oka, Justice Ahsanuddin Amanullah and Justice Augustine George Masih allowed the state to file a counter affidavit to raise the said objection. The bench said that it would look into the objection raised by the state.<\/p>\n<p>During the resumed hearing on Wednesday, the bench enquired about the status of the cases filed against Naik. The bench was told by the counsel for Naik that there are a total of 43 cases against him.<\/p>\n<p><!--\/include_growfast.cms?pagename=article&skipcss=1potime:2--><br \/>Zakir Naik, who is currently abroad, has been under investigation by the <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/national-investigation-agency\" target=\"_blank\" rel=\"noopener\">National Investigation Agency<\/a> and <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/enforcement-directorate\" target=\"_blank\" rel=\"noopener\">Enforcement Directorate<\/a> for several years.
