However, the video is still visible outside India on YouTube and everyone can watch it, it said, adding that Google \u201cintentionally and deliberately\u201d did not remove the video which contained false and malicious allegations tarnishing its reputation.\u201cGoogle was applying delay tactics and seeking adjournment on flimsy grounds, even as damage was caused to Dhyan Foundation and Yogi Ashwini ji&#8217;s immaculate character and reputation,\u201d the NGO said.However, YouTube, owned by Google, had claimed immunity as an intermediary under the Information Technology Act (IT Act). It argued that defamation does not fall under the categories listed in Section 69-A of the Act, which allows for blocking content. The platform stated that such grievances should be addressed in civil courts, not criminal courts.<\/p>\n<p>The court, however, rejected YouTube&#8217;s technical objections, stating that the IT Act does not explicitly bar criminal courts from intervening in such matters. \u201cSo far as authorities filed by the respondent are salutary for me. In the said authorities the procedure is mentioned. However, no where it is mentioned that criminal court has no jurisdiction to entertain such application. Therefore, in my humble opinion, the ratio of above said authorities will not bar maintainability of the present application,\u201d the order said.<\/p>\n<p>The magistrate noted that the video\u2019s defamatory nature was undisputed and its continued circulation could harm public peace.<\/p>\n<p>\u201cThe sentiments of followers of any organisation in India are very sensitive particularly when it comes regarding belief.
