{"id":189977,"date":"2024-12-06T17:36:06","date_gmt":"2024-12-06T17:36:06","guid":{"rendered":"https:\/\/news.talkwithrattan.com\/index.php\/2024\/12\/06\/tiktok-loses-appeal-against-us-ban-law\/"},"modified":"2024-12-06T17:36:06","modified_gmt":"2024-12-06T17:36:06","slug":"tiktok-loses-appeal-against-us-ban-law","status":"publish","type":"post","link":"https:\/\/news.talkwithrattan.com\/index.php\/2024\/12\/06\/tiktok-loses-appeal-against-us-ban-law\/","title":{"rendered":"TikTok loses appeal against US ban law"},"content":{"rendered":"<div style=\"text-align:center\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/i0.wp.com\/ichef.bbci.co.uk\/news\/1024\/branded_news\/d8a2\/live\/d8cb3550-b3ea-11ef-b4ee-7f3a9069a0a6.jpg?resize=1024,576&amp;ssl=1\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"TikTok loses appeal against US ban law\" title=\"TikTok loses appeal against US ban law\" \/><\/div><p> <br \/>\n<\/p>\n<div data-component=\"text-block\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">TikTok&#8217;s bid to overturn a law which would see it banned or sold in the US from early 2025 has been rejected.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The social media company had hoped a federal appeals court would uphold its argument that the law was unconstitutional.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">TikTok&#8217;s lawyers told the court in September that a ban <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c5y3y79llndo\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">would have a &#8220;staggering&#8221; impact on the free speech of its 170 million US users.<!-- --><\/a><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">But the court ruled the law &#8220;was the culmination of extensive, bipartisan action by the Congress and by successive presidents.&#8221;<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The law was &#8220;carefully crafted to deal only with control by a foreign adversary, and it was part of a broader effort to counter a well-substantiated national security threat posed by the PRC (People&#8217;s Republic of China),&#8221; the ruling continues.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The US wants TikTok sold or banned because of what it says are its owners links to the Chinese state &#8211; links TikTok and parent company Bytedance have always denied.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">TikTok and its parent company may now choose to take their ongoing fight against the law to higher courts in the US &#8211; including to the Supreme Court, its highest authority.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Donald Trump&#8217;s victory in the 2024 US Presidential Election may also present a lifeline for the app.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Despite unsuccessfully attempting to ban TikTok during his first term in 2020, he said in the run-up to the November elections he would not allow the ban on TikTok to take effect.<!-- --><\/p>\n<\/div>\n<div data-component=\"text-block\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">TikTok and ByteDance have previously stressed that they will not sell the platform. <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">They are yet to react to this ruling,<!-- --><b id=\"\" class=\"sc-7dcfb11b-0 kVRnKf\"> <!-- --><\/b>but the BBC has asked them for a response.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The US Court of Appeals&#8217; District of Columbia circuit striking down TikTok&#8217;s petition to review the law means that the platform is set to be made unavailable to US users from 19 January.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Trump had <!-- --><a target=\"_blank\" href=\"https:\/\/feeds.bbci.co.uk\/news\/articles\/cyjj08vvz43o\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">joined the platform during his campaign<!-- --><\/a> and claimed that curtailing TikTok would unfairly benefit Facebook.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Meta, which owns Facebook as well as Instagram, WhatsApp and Threads, has sought to build rivals to TikTok&#8217;s short form videos within its own apps, and <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cmm3yn4pr17o\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">made changes that users have likened to TikTok amid questions over the app&#8217;s US future<!-- --><\/a>.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">He has so far made no comment on the ruling.<!-- --><\/p>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.bbc.com\/news\/articles\/c2ldnq5095xo\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>TikTok&#8217;s bid to overturn a law which would see it banned or sold in the US from early 2025 has been rejected.
