{"id":210268,"date":"2025-01-08T02:57:51","date_gmt":"2025-01-08T02:57:51","guid":{"rendered":"https:\/\/news.talkwithrattan.com\/index.php\/2025\/01\/08\/ireland-joins-south-africas-genocide-case-against-israel\/"},"modified":"2025-01-08T02:57:51","modified_gmt":"2025-01-08T02:57:51","slug":"ireland-joins-south-africas-genocide-case-against-israel","status":"publish","type":"post","link":"https:\/\/news.talkwithrattan.com\/index.php\/2025\/01\/08\/ireland-joins-south-africas-genocide-case-against-israel\/","title":{"rendered":"Ireland Joins South Africa\u2019s Genocide Case Against Israel"},"content":{"rendered":"<div style=\"text-align:center\"><img decoding=\"async\" src=\"https:\/\/i0.wp.com\/static01.nyt.com\/images\/2025\/01\/07\/multimedia\/07ireland-icj-01-qckh\/07ireland-icj-01-qckh-facebookJumbo.jpg?ssl=1\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"Ireland Joins South Africa\u2019s Genocide Case Against Israel\" title=\"Ireland Joins South Africa\u2019s Genocide Case Against Israel\" \/><\/div><p> <br \/>\n<\/p>\n<div data-testid=\"companionColumn-0\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Ireland has formally joined South Africa\u2019s genocide case against Israel, <a class=\"css-yywogo\" href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/192\/192-20250107-pre-01-00-en.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">according to a statement<\/a> on Tuesday from the International Court of Justice.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The filing, made on Monday, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/03\/28\/world\/middleeast\/ireland-south-africa-israel-genocide-icj.html\" title=\"\">comes months after Ireland announced plans<\/a> to intervene in the case before the United Nations\u2019 <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/01\/12\/world\/middleeast\/israel-genocide-icj-south-africa-explained.html\" title=\"\">highest judicial body<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIreland, invoking Article 63 of the Statute of the Court, filed in the Registry of the Court a declaration of intervention in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip,\u201d the court said in a statement on Tuesday.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">South Africa <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/12\/29\/world\/middleeast\/south-africa-israel-genocide.html\" title=\"\">brought its case to the I.C.J.<\/a> in December 2023, accusing Israel of committing genocide in Gaza. Israel has strongly rejected the allegation, describing South Africa\u2019s filing as a \u201cdespicable and contemptuous exploitation of the Court.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In an initial ruling in January 2024, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/live\/2024\/01\/26\/world\/israel-hamas-gaza-news#here-are-the-latest-developments\" title=\"\">the court ordered Israel<\/a> to restrain its <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/07\/16\/world\/middleeast\/israel-hamas-gaza.html\" title=\"\">attacks in Gaza<\/a>, and in May it ordered the country to immediately <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/05\/24\/world\/middleeast\/icj-israel-gaza-rafah-ruling.html\" title=\"\">halt its military offensive<\/a> in the city of Rafah, in southern Gaza.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The United Nations allows countries to \u201cintervene\u201d in proceedings if they are parties to the United Nations\u2019 1948 Genocide Convention.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A spokesperson for Ireland\u2019s Department of Foreign Affairs confirmed the filing on Tuesday. \u201cIt is important for the Court, in its consideration of any multilateral convention, to understand how other parties to that convention interpret and apply it,\u201d it said in a statement.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The filing was long anticipated. Last month, the government approved a plan to file its argument in the case, with Miche\u00e1l Martin, the deputy prime minister and minister for foreign affairs, saying that it would be filed in The Hague, where the court is based, within weeks.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThere has been a collective punishment of the Palestinian people through the intent and impact of military actions of Israel in Gaza, leaving 44,000 dead and millions of civilians displaced,\u201d Mr. Martin said in December, adding that Ireland would ask the court to broaden its interpretation of what constitutes the commission of genocide by a state.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cWe are concerned that a very narrow interpretation of what constitutes genocide leads to a culture of impunity in which the protection of civilians is minimized,\u201d he added.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Experts say the court is not expected to rule on the genocide charge for years.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The decision to intervene in the case reflects <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/12\/02\/world\/europe\/ireland-palestinians-support.html\" title=\"\">Ireland\u2019s longstanding support for Palestinian civilians<\/a>, rooted in part in a shared history of British colonialism and in Ireland\u2019s own experience with a seemingly intractable sectarian conflict \u2014 The Troubles, which came to a close with the 1998 Good Friday Agreement.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Last month, Israel announced it was <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/12\/15\/world\/middleeast\/israel-closes-embassy-ireland.html\" title=\"\">closing its embassy<\/a> in Dublin, citing what it said were \u201cthe extreme anti-Israel policies of the Irish government.\u201d Israeli officials said the action did not mean that Israel was severing diplomatic relations with Ireland.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/www.nytimes.com\/2025\/01\/07\/world\/europe\/ireland-icj-israel-genocide.html\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ireland has formally joined South Africa\u2019s genocide case against Israel, according to a statement on Tuesday from the International Court of Justice.
