We will not tolerate such conduct on the part of the Union of India to make submissions expressly contrary to statute. We will never appreciate such submission made by the Union of India,&#8221; the bench verbally remarked.<\/p>\n<p>The development took place during the resumed hearing of a plea challenging denial of bail to a woman accused of money laundering. The bench had last month taken strong exception to ED&#8217;s argument that rigorous bail conditions under section 45 of PMLA would apply to women, sick, infirm and persons under 16 years of age.<\/p>\n<p><!--\/include_growfast.cms?pagename=article&skipcss=1potime:1--><br \/>The bench had further observed that the stance taken by ED seemed to be flying in the face of the PMLA provisions since the proviso to section 45 grants exception to women, sick, infirm and persons under 16 years of age. The said argument was raised by an ASG last month.<strong>SG Clarifies; Bench Unimpressed<\/strong>Appearing on behalf of ED on Wednesday, Solicitor General Tushar Mehta submitted that the said proviso does apply to women in PMLA cases. &#8220;There was some communication gap,&#8221; Mehta said.<\/p>\n<p>The court, however, seemed unimpressed with the argument.
