{"id":22078,"date":"2024-04-09T10:12:23","date_gmt":"2024-04-09T10:12:23","guid":{"rendered":"https:\/\/news.talkwithrattan.com\/index.php\/2024\/04\/09\/switzerlands-climate-shortfalls-violate-rights-european-court-rules\/"},"modified":"2024-04-09T10:12:23","modified_gmt":"2024-04-09T10:12:23","slug":"switzerlands-climate-shortfalls-violate-rights-european-court-rules","status":"publish","type":"post","link":"https:\/\/news.talkwithrattan.com\/index.php\/2024\/04\/09\/switzerlands-climate-shortfalls-violate-rights-european-court-rules\/","title":{"rendered":"Switzerland\u2019s Climate Shortfalls Violate Rights, European Court Rules"},"content":{"rendered":"<div style=\"text-align:center\"><img loading=\"lazy\" decoding=\"async\" width=\"1050\" height=\"550\" src=\"https:\/\/i2.wp.com\/static01.nyt.com\/images\/2024\/04\/09\/multimedia\/09europe-climate-vgfw\/09europe-climate-vgfw-facebookJumbo.jpg?resize=1050,550&amp;ssl=1\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"Switzerland\u2019s Climate Shortfalls Violate Rights, European Court Rules\" title=\"Switzerland\u2019s Climate Shortfalls Violate Rights, European Court Rules\" \/><\/div><p> <br \/>\n<\/p>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Europe\u2019s top human rights court said in a landmark ruling on Tuesday that the Swiss government had violated its citizens\u2019 human rights by not doing enough to stop climate change.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But the court rejected climate-related cases brought by the former mayor of a coastal town in France and a group of young people in Portugal as inadmissible.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The cases, the first of their kind to be heard at the court, the European Court of Human Rights in Strasbourg, France, are part of a broader movement of <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/08\/14\/us\/montana-youth-climate-ruling.html\" title=\"\">climate-related lawsuits<\/a> that aim to use human rights law to <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/08\/28\/climate\/united-nations-children-climate-lawsuit.html\" title=\"\">push governments to act against global warming<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The rulings focused on three cases, filed by members of the public in France, Portugal and Switzerland who argued that their governments, by not doing enough to mitigate climate change, were violating the citizens\u2019 rights under the European Convention on Human Rights.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The court \u201chas actually said that by not meeting its targets on climate, Switzerland has violated the rights of the European human rights convention,\u201d said Annalisa Savaresi, a professor of environmental law at University of Stirling in Scotland.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">National courts would be watching the ruling closely, she said. \u201cThis is huge.\u201d<\/p>\n<h3 class=\"css-15h6bi9 e1gnsphs0\" id=\"link-2b0ae66d\"><span>Older women vs. Switzerland<\/span><\/h3>\n<p class=\"css-at9mc1 evys1bk0\">A <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/08\/06\/world\/europe\/heat-wave-older-women-lawsuit.html\" title=\"\">group of Swiss women<\/a> age 64 and up \u2014 known as the KlimaSeniorinnen, or Senior Women for Climate Protection \u2014 argued in their lawsuit that the Swiss government\u2019s failure to reduce greenhouse emissions enough to stop global warming has violated their rights to life and autonomy.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">With heat waves sweeping Switzerland in recent summers and older women particularly <a class=\"css-yywogo\" href=\"https:\/\/mediarelations.unibe.ch\/media_releases\/2023\/media_releases_2023\/global_warming_caused_60_percent_of_swiss_heat_deaths_in_the_summer_of_2022\/index_eng.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">vulnerable to heat-related illnesses<\/a>, the litigants said that the government had not acted enough to protect their final decades. The Swiss government argues that human rights law does not apply to climate change, and that addressing it should be a political process.<\/p>\n<h3 class=\"css-15h6bi9 e1gnsphs0\" id=\"link-243d3b20\"><span>A mayor vs. France<\/span><\/h3>\n<p class=\"css-at9mc1 evys1bk0\">A second case focuses on a complaint by Damien Car\u00eame, a former mayor of Grande-Synthe, a town on the coast of the English Channel, that France has taken insufficient steps to prevent global warming, thus endangering the town.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Car\u00eame, who was the town\u2019s mayor from 2001 to 2019 and is now a member of the European Parliament for France\u2019s Green party, argued that this failure violates the right to life, which is enshrined in European law. The town of Grande-Synthe is expected to be particularly affected as it faces an increased flooding risk in the coming decades because of climate change.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<h3 class=\"css-15h6bi9 e1gnsphs0\" id=\"link-43533917\"><span>Portuguese youth vs. 33 countries<\/span><\/h3>\n<p class=\"css-at9mc1 evys1bk0\">Six Portuguese young people born from 1999 to 2012 argued in a third case that the current and future effects of climate change \u2014 including heat waves, wildfires and the smoke from those blazes \u2014 are affecting their lives, well-being and mental health.
