He pointed to a legal provision that allows state governments to appeal sentences in cases where the punishment is deemed inadequate, citing the amendment of Section 377 as an example where such rights were expanded.<\/p>\n<p>&#8220;The <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> has held that the central government alone had the power to appeal in such cases, but after the amendment to Section 377, it is now clear that the state government can also seek a penalty in cases of inadequate punishment,&#8221; Dutta explained.<\/p>\n<p>Dutta went on to explain that both the CBI and the state government were in agreement that Roy\u2019s life imprisonment sentence was insufficient, with both parties seeking the death penalty. He also referred to precedent cases, including that of former Bihar Chief Minister Lalu Prasad Yadav, to support the argument for the state\u2019s right to appeal in such matters.<\/p>\n<p><!--\/include_growfast.cms?pagename=article&skipcss=1potime:2--><br \/><a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/justice-debangsu-basak\" target=\"_blank\" rel=\"noopener\">Justice Debangsu Basak<\/a>, presiding over the case, observed that the object of both the CBI and the state\u2019s appeals was the same \u2014 the pursuit of a harsher sentence for Roy.
