It asked all the officers who had served as district ayurvedic and unani officers from 2018 till now to file affidavits within two weeks, explaining their inaction against <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" target=\"_blank\" href=\"https:\/\/economictimes.indiatimes.com\/industry\/patanjali-india\" rel=\"noopener\">Patanjali<\/a> Ayurved.<\/p>\n<p>Irked by Ramdev and Balakrishna\u2019s apology only \u201con paper after they were caught on the wrong foot in court,\u201d a Bench of justices <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/hima-kohli\" target=\"_blank\" rel=\"noopener\">Hima Kohli<\/a> and Ahsanuddin Amanullah in unequivocal terms said: \u201cWe decline to accept the apology. We consider what you have done to be wilful, deliberate, repeated violation of our orders. We don\u2019t want to be so generous in this case. We have expressed our reservations about accepting the latest affidavit filed. Why should we not treat your apology with the same disdain as shown to court undertaking? We are not convinced.\u201d<\/p>\n<p>Ramdev and Balkrishna had on Tuesday tendered unconditional apologies in two separate affidavits for violating the undertaking given by the company for not publishing such claims on their products.<\/p>\n<p>The Bench on Wednesday also noted that the contemnors tried to evade personal appearance before it by making false claims of travel abroad. In the affidavit filed on March 30, they had said that flight tickets were annexed, but the tickets were not in existence on the date of filing of the affidavit. <\/p>\n<p>\u201cWe have also pointed out that even after show cause notices, the proposed contemnors attempted to wriggle out of physical appearances,\u201d Justice Kohli noted in her order while posting the matter for directions on April 16.The top court also said that &#8220;a message has to go to the society at large&#8221; when dealing with such misleading ads. The issue is not only related to Pantanjali but also to other fast moving consumer goods companies which paint a \u201crosy\u201d picture of their products and play with the health of the innocent public while government fails to crack the whip, it said.\u201cThe victim is always the public. We are concerned with all those FMCG companies who are taking their consumers and clients up and down the garden path, showing them very rosy pictures about what their products can do for them. People who pay good money for these products finally end up suffering at the cost of their health\u2026 That is absolutely unacceptable,\u201d Justice Kohli observed.<\/p>\n<p>The court also came down on the Uttarakhand drug licensing authority for not taking any action against Patanjali Ayurved. \u201cYou were in deep slumber from 2018, when the first complaint came about their products, to 2024. When they (<a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/divya-pharmacy\" target=\"_blank\" rel=\"noopener\">Divya Pharmacy<\/a>) violated statements made to you, what did you do? Sit and wiggle your thumbs? You waited for us to prod you?\u201d Justice Kohli questioned a senior official from the Authority who was present in the courtroom.<\/p>\n<p>&#8220;We are not going to let you (licensing authority) free. All complaints were forwarded to you. Take note, we want a reply on everything,&#8221; the judges said, while taking a strong objection to the use of the word &#8216;bona fide&#8217; for officers. \u201cWe are not going to take (it) lightly. We will rip you apart&#8230; See how correspondence has progressed&#8230; Officers were just sitting pretty and only pushed files,&#8221; Justice Kohli said.<\/p>\n<p>The court then directed the State Licensing Authority officers-in-charge, the present one and his predecessor, to file detailed affidavits on why action had not been taken against Divya Pharmacy under the Drugs and Magic Remedies (Objectionable Advertisements) Act.
