{"id":260689,"date":"2025-03-17T15:37:04","date_gmt":"2025-03-17T15:37:04","guid":{"rendered":"https:\/\/news.talkwithrattan.com\/index.php\/2025\/03\/17\/delhi-hc-issues-notice-to-npci-over-alleged-patent-infringement-on-upi-credit-card-payments\/"},"modified":"2025-03-17T15:37:04","modified_gmt":"2025-03-17T15:37:04","slug":"delhi-hc-issues-notice-to-npci-over-alleged-patent-infringement-on-upi-credit-card-payments","status":"publish","type":"post","link":"https:\/\/news.talkwithrattan.com\/index.php\/2025\/03\/17\/delhi-hc-issues-notice-to-npci-over-alleged-patent-infringement-on-upi-credit-card-payments\/","title":{"rendered":"Delhi HC issues notice to NPCI over alleged patent infringement on UPI credit card payments"},"content":{"rendered":"<div style=\"text-align:center\"><img decoding=\"async\" src=\"https:\/\/i3.wp.com\/img.etimg.com\/photo\/118783427.cms?ssl=1\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"Delhi HC issues notice to NPCI over alleged patent infringement on UPI credit card payments\" title=\"Delhi HC issues notice to NPCI over alleged patent infringement on UPI credit card payments\" \/><\/div><p> <br \/>\n<\/p>\n<div data-brcount=\"21\">The <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/delhi-high-court\" target=\"_blank\" rel=\"noopener\">Delhi High Court<\/a> has issued notice to National Payments Corp. of India (NPCI), which allegedly has been using On4Off Trading&#8217;s <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/patented-technology-process\" target=\"_blank\" rel=\"noopener\">patented technology process<\/a> for aggregating <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/unified-payments-interface\" target=\"_blank\" rel=\"noopener\">Unified Payments Interface<\/a> payments using credit cards.<\/p>\n<p><!--\/dynamic_link.cms?msid=107107653&subsecid=1715249553&pos=toppotime:1-->On4Off Trading had had moved the HC seeking to restrain NPCI, the third-party application providers like Paytm Payments Bank, Google India Digital Services (Google Pay), SamsungWallet, PhonePe, etc and banking institutions, including <a rel=\"dofollow noopener\" href=\"https:\/\/economictimes.indiatimes.com\/punjab-national-bank\/stocks\/companyid-11585.cms\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" target=\"_blank\">PNB<\/a> and <a rel=\"dofollow noopener\" href=\"https:\/\/economictimes.indiatimes.com\/canara-bank\/stocks\/companyid-9218.cms\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" target=\"_blank\">Canara Bank<\/a>, and others from infringing on its patent process, besides asking for compensatory damages for \u201cillegal use or facilitation\u201d of its patented process.<\/p>\n<p>It had claimed that these defendants were \u201cgaining illegal benefits through the unauthorised use\u201d of its process which was invented way back in 2017.<\/p>\n<p>In January, Justice Amit Bansal had referred the parties to mediation and appointed former SC judge Justice <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/a-k-sikri\" target=\"_blank\" rel=\"noopener\">A.K. Sikri<\/a> to resolve a dispute between On4Off Trading and NPCI. However, the mediator had filed its report stating that the mediation proceedings were a \u201cnon-starter,\u201d the court said in its March 11 order. It posted the matter for further hearing on August 27.<\/p>\n<p>On4Off Trading had told the court that NCPI was using the patented process, which was assigned to On4Off, without any license or permission. \u201cBy facilitating transactions through RuPay Credit Cards with UPI QR Codes, NPCI has internalised the entire process developed by the inventor, in as much as both the RuPay and the UPI are the products of NPCI,\u201d the petition stated.<\/p>\n<div style=\"display:none;\" data-ga-impression=\"Events_widget_$pagename#Impression#url\" class=\"liveEventMain_widget custom_ad\">\n<div class=\"topContain\">\n<div class=\"imgBox\"><\/div>\n<h3 class=\"logoTitle\">Live Events<\/h3>\n<\/div>\n<\/div>\n<p><!--\/live_events_widget.cms?pagename=articlepotime:1--><br \/>Allowing linkage of only RuPay credit cards with UPI is a business strategy implemented by NPCI to <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" target=\"_blank\" href=\"https:\/\/economictimes.indiatimes.com\/definition\/leverage\" rel=\"noopener\">leverage<\/a> illegal benefits from the unauthorised use of the patented process, On4Off stated, adding that this was also affecting the market of the other card manufacturers who have been authorized to sell their credit cards in India.\u201cAs per the data published also available on the website of NPCI in October 2023 total transaction of Rs 100 crore have been facilitated through RuPay Credit Cards on <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/upi-qr-code\" target=\"_blank\" rel=\"noopener\">UPI QR Code<\/a> and during the weekends the figure reached up to Rs 150-200 crore,\u201d the petition filed through counsel Anuroop Omkar from AK &amp; Partners stated.On4Off claimed that one of its directors, along with his two children \u2013 Sujasini Bhattacharya and her brother Sujit (minor), had patented the process that allows one to make a monetary transaction from a credit card after scanning a UPI Quick Response code. They invented a method and system that facilitates payments through various financial instruments after scanning the UPI code, it said, adding that the application for grant of patent was filed in January 2022.<\/p>\n<p>According to the petitioner, the then Reserve Bank of India governor Shaktikanta Das had issued a statement which said that the central bank was planning to allow linking RuPay credit cards with UPI. Thereafter in October 2022, the RBI issued a circular thereby allowing UPI transactions using RuPay credit cards after scanning a UPI QR Code. Earlier the UPI transactions were only allowed through debit cards. Vide the said circular, now, a transaction can be facilitated using<\/p>\n<p>Earlier, UPI transactions were only allowed through debit cards, the counsel said.
