In a strongly worded letter to the Chief Justice and Judges of the Allahabad High Court, the association stated, “We aren’t a trash bin,” expressing shock at the Supreme Court Collegium’s decision.

“The decision of the Collegium raises a serious question – is the Allahabad High Court a trash bin? This matter becomes important when we examine the current situation… wherein the Allahabad High Court is short of judges… new judges have not been appointed for many years,” the statement read.

Senior advocate and association president Anil Tiwari signed the resolution, reiterating that while the High Court faces ongoing issues, it cannot be treated as a dumping ground for controversial appointments. “Presently, we are facing so many problems, particularly shortage of judges resulting in fresh cases not being heard for months, thereby diminishing the faith of the public in the rule of law. But it does not mean we are a trash bin. We are not ready to accept corruption,” the statement added.

Fire Leads to Cash Discovery

Justice Varma was not at home when a fire broke out at his official residence. His family members alerted emergency services, and after the fire was doused, first responders found a massive sum of cash in one of the rooms. The discovery immediately raised suspicions, prompting local police to report the matter to senior officials.

The case quickly escalated to top government authorities and was brought to the attention of Chief Justice of India Sanjiv Khanna, who convened an urgent meeting of the Supreme Court Collegium.

Live Events

Supreme Court’s Response and Inquiry

Following deliberations, the Supreme Court Collegium unanimously decided to transfer Justice Varma back to his parent High Court in Allahabad. However, some members felt this step alone was inadequate and could further tarnish the judiciary’s reputation. They suggested that Justice Varma either resign or face an in-house inquiry, which could ultimately lead to his removal by Parliament. “It is also of grave concern that while appointing judges by elevating members of the Bar, the Bar was never consulted. Consideration of eligibility appears to be not up to the mark. Something is lacking, which has resulted in corruption and, consequently, great damage to public faith in the judiciary,” the Bar Association noted.According to standard procedure, the Chief Justice of India first seeks the judge’s response before deciding on further steps. If needed, a panel consisting of a Supreme Court judge and two High Court Chief Justices may be formed to investigate the matter.

Justice Varma’s Legal Background

Born on 6 January 1969 in Allahabad, Justice Yashwant Varma completed his B.Com (Honours) from Hansraj College, Delhi University, and obtained his LLB from Rewa University, Madhya Pradesh.

He enrolled as an advocate in 1992 and practised constitutional, labour, industrial, corporate, taxation, and allied laws. He served as special counsel for the Allahabad High Court from 2006 until his elevation and was the chief standing counsel for the Uttar Pradesh government from 2012 to 2013.

Appointed as an additional judge of the Allahabad High Court on 13 October 2014, he was made a permanent judge on 1 February 2016. Later, he was transferred to the Delhi High Court, where he was serving until the recent controversy erupted.

With the legal community divided and an inquiry likely, the case has raised pressing concerns about judicial accountability, transparency, and the process of appointments within the Indian judiciary.

Source link

The Allahabad High Court Bar Association has fiercely opposed the repatriation of Justice Yashwant Varma following the discovery of Rs 15 crore in unaccounted cash at his official residence.
