The Nagpur bench of the Bombay High Court<\/a> on Monday halted a move of local civic authorities to demolish the homes of alleged rioters claimed to be involved in the recent Nagpur violence<\/a>.<\/p>\n

The division bench issued a notice to the Maharashtra government<\/a>, asking it to file its reply by April 15. <\/p>\n

The Nagpur civic body<\/a> demolished the two-storey home of Fahim Khan<\/a>, alleged to be one of the main accused in the riots. The civic body had issued a notice under the Maharashtra Regional Town Planning Act on March 21 on the property which was in the name of Khan’s mother Mehrunisa. According to the civic body, the house was located on a plot of the Nagpur Improvement Trust and the lease had ended in 2020.<\/p>\n

Mehrunisa had approached the Nagpur bench of the Bombay HC, however, by the time a division bench of justices Nitin Sambre and Vrushali Joshi stayed the action, the civic body had demolished the entire home. <\/p>\n

The civic body was also planning to demolish the home of another alleged rioter also. But after the court’s stay, it had to be cancelled.<\/p>\n

Mehrunisa and Abdul Hafiz, relatives of the two accused, contented that the Nagpur civic body’s action targeting the homes was violative of the recent Supreme Court order<\/a> which held that demolition of a citizen’s home without following due process of law<\/a> merely because the individual is a suspect or a convict will be “totally unconstitutional”. Pending its final verdict, the SC had issued guidelines for state governments that mandated a 15-day notice period for occupants to respond to allegations of their structure being illegal. The apex court also held that if homes are demolished without adhering to legal procedures, then the families would be entitled to compensation and officers involved in such demolitions would face legal action. <\/p>\n

The development comes on a day when SC issued a notice to the Malvan civic body after it demolished the home of a scrap dealer on February 24 for his minor son’s alleged slogan favouring Pakistan during India-Pakistan cricket match.
