Guwahati: Assam\u2019s Advocate General Devajit Saikia<\/a> has sought cancellation of his membership from Gauhati High Court Bar Association<\/a>.<\/p>\n

In a letter to President Gauhati High Court<\/a> Bar Association, he stated , \u201cOf late, it has come to my notice that the Gauhati High Court Bar Association has taken a firm decision to oppose the proposed shifting of the existing Gauhati High Court premise to North Guwahati, and, has also resorted to various programs of protests and demonstrations.” <\/p>\n

“Presently, as holding the post of the Advocate General, Assam, my constitutional and official duty demand that I must stand by the decision of the Hon’ble Gauhati High Court and Government of Assam regarding proposed shifting of the court premise, which is being aimed to provide a much better and conducive environment to the legal fraternity<\/a>, comprising of the lawyers, judges, litigants, registry and multiple other stakeholders in times ahead\u201d.<\/p>\n

He added, \u201cPersonally also, I, without any hesitation, support the decision and process to shift the present High Court premise to the proposed new location which is not only the call of the hour due to various deficiencies and shortfalls in the existing infrastructure but also it will provide a much better working ambience to the new generation and upcoming lawyers while mitigating all existing deficiencies.” <\/p>\n

“Now, it is quite apparent that while discharging duty in my official\/constitutional as well as in my personal capacity on the issue of shifting of the Gauhati High Court premise, I foresee numerous situations in which there may arise conflict of interest<\/a> due to the diametrically opposite stands of the Gauhati High Court and Government of Assam on one side, while GHCBA on the other\u201d.<\/p>\n

He stated, \u201cin order to avoid any such occasion, I earnestly request you to cancel my membership of the Gauhati High Court Bar Association forthwith. Please treat this as my resignation letter, which I am also submitting in the greater interest of the present and the future generation of lawyers, and, for overall betterment of justice delivery system\u201d.
