{"id":277067,"date":"2025-04-08T14:30:22","date_gmt":"2025-04-08T14:30:22","guid":{"rendered":"https:\/\/news.talkwithrattan.com\/index.php\/2025\/04\/08\/delhi-hc-refuses-to-stay-order-asking-wikipedia-to-remove-alleged-defamatory-description-of-ani\/"},"modified":"2025-04-08T14:30:22","modified_gmt":"2025-04-08T14:30:22","slug":"delhi-hc-refuses-to-stay-order-asking-wikipedia-to-remove-alleged-defamatory-description-of-ani","status":"publish","type":"post","link":"https:\/\/news.talkwithrattan.com\/index.php\/2025\/04\/08\/delhi-hc-refuses-to-stay-order-asking-wikipedia-to-remove-alleged-defamatory-description-of-ani\/","title":{"rendered":"Delhi HC refuses to stay order asking Wikipedia to remove alleged defamatory description of ANI"},"content":{"rendered":"<div style=\"text-align:center\"><img decoding=\"async\" src=\"https:\/\/i3.wp.com\/img.etimg.com\/photo\/118783427.cms?ssl=1\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"Delhi HC refuses to stay order asking Wikipedia to remove alleged defamatory description of ANI\" title=\"Delhi HC refuses to stay order asking Wikipedia to remove alleged defamatory description of ANI\" \/><\/div><p> <br \/>\n<\/p>\n<div data-brcount=\"21\">The division bench of the <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/delhi-high-court\" target=\"_blank\" rel=\"noopener\">Delhi High Court<\/a> on Tuesday refused to stay its single-judge bench&#8217;s direction to <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/wikipedia\" target=\"_blank\" rel=\"noopener\">Wikipedia<\/a> to take down the alleged <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/defamatory-description\" target=\"_blank\" rel=\"noopener\">defamatory description<\/a> of <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/asian-news-international\" target=\"_blank\" rel=\"noopener\">Asian News International<\/a> (ANI) on its Wikipedia page.<\/p>\n<p><!--\/dynamic_link.cms?msid=107107653&subsecid=1715249553&pos=toppotime:1-->A Bench comprising Justices Pratibha Singh and Rajneesh Kumar Gupta said that Wikipedia and its host <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/wikimedia-foundation\" target=\"_blank\" rel=\"noopener\">Wikimedia Foundation<\/a> are bound by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and if the defamatory content was not taken down within 36 hours, ANI Media can approach this court.<\/p>\n<p>The bench further said that if Wikipedia claims to be an intermediary, it cannot challenge a court&#8217;s decision on merits. \u201cYou have already pleaded you are an intermediary. Under IT Rules, their job is only to give effect to what the court of law directs. You cannot defend it on merits. If you are an intermediary and the court directs you to take down, you cannot even argue on merits,&#8221; the court said.<\/p>\n<p>However, the division bench stayed a part of the single judge&#8217;s order which had asked Wikipedia and its host to remove the protection status imposed on the ANI page. The court also stayed the order that restricted Wikipedia&#8217;s users and administrators from publishing anything defamatory against ANI Media on its platform.<\/p>\n<p>The \u2018protection status\u2019 allows only admins to edit a Wiki page.<\/p>\n<div style=\"display:none;\" data-ga-impression=\"Events_widget_$pagename#Impression#url\" class=\"liveEventMain_widget custom_ad\">\n<div class=\"topContain\">\n<div class=\"imgBox\"><\/div>\n<h3 class=\"logoTitle\">Live Events<\/h3>\n<\/div>\n<\/div>\n<p><!--\/live_events_widget.cms?pagename=articlepotime:1--><br \/>Justice Singh said if similar defamatory material comes up on Wikipedia page, ANI Media can inform the platform , which will take it down.During the hearing, the judge observed that Wikipedia was nothing but an <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/online-encyclopedia\" target=\"_blank\" rel=\"noopener\">online encyclopedia<\/a> and the intention of the publisher should be to take a neutral stance. After perusing the live website of Wikipedia&#8217;s ANI page, the court said that it seemed to suggest there was substantial content wherein allegations like bias and other defamatory material were raised against the news agency.On April 2, Justice Subramonium Prasad in an interim order had ordered the removal of allegedly defamatory descriptions about ANI on its Wikipedia page and had also restrained its users and administrators from publishing anything defamatory against the news agency.<\/p>\n<p>Justice Prasad\u2019s direction had come in a <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/defamation-suit\" target=\"_blank\" rel=\"noopener\">defamation suit<\/a> filed by ANI against Wikipedia and its host Wikimedia Foundation, wherein it sought to restrain the latter from putting defamatory content against the news agency and remove such content on the page.
