The Delhi High Court<\/a> on Tuesday asked a dermatologist<\/a> and two social media influencers<\/a> to drop objectionable content from their podcast video<\/a> that allegedly made false, misleading, and disparaging remarks about Reckitt Benckiser<\/a> India\u2019s antiseptic product Dettol<\/a>.<\/p>\n

A bench led by Justice Saurabh Banerjee<\/a> after taking note of a settlement agreement reached between the parties directed dermatologist Dr Manjot Marwah and influencers Raj Shamani and Ritik Chaturvedi on to edit the content within 24 hours.<\/p>\n

It also restrained Shamani from reuploading the content and asked the parties to abide by the agreement.<\/p>\n

Shamani undertook before the court to cut his podcast video and remove the portion where allegedly disparaging claims were made about Dettol antiseptic liquid<\/a> by Marwah.<\/p>\n

During the initial hearing Justice Banerjee had suggested that a more practical solution would be to take down the video completely and upload a new version of it. However, the counsel appearing for influencers told the court that his instructions were only to edit the portion with reference to Dettol antiseptic liquid.<\/p>\n

Marwah’s counsel also argued that in order to \u201cput a quietus\u201d to the dispute, the dermatologist had already removed the reel posted on her instagram account which had reference to Dettol antiseptic liquid. Chaturvedi had also removed the reel uploaded on his instagram account.The directions came on a defamation suit<\/a> by Reckitt Benckiser against Marwah and the two influencers who allegedly made “false, misleading, disparaging and defamatory” statements about Dettol Antiseptic Liquid in a podcast.In the you tube video and an instagram reel, there were statements that the antiseptic liquid cannot be used as a drug or medicine and it is to be used as a floor cleaning. There were also claims in the video that Dettol burns the wound or skin and delayed healing.<\/p>\n

Reckitt had argued that Dettol antiseptic liquid was a licensed product approved for use on skin and was marked as an antiseptic liquid in India since 1936. The product qualifies as a drug under Drugs and Cosmetics Act, 1940. \u201cTo call Dettol a disinfectant only fit for mopping floors is blatantly false and slanderous,\u201d said the Reckitt counsel argued, adding that the online content was to drive viewership for the podcast and promote Marwah’s dermatology clinic.<\/p>\n

\u201cThe reel damages me irreparably even if it\u2019s up for an hour. The podcast can continue, just remove the part that speaks about Dettol,\u201d Reckitt’s counsel had argued.
