Rana, a close associate of 26\/11 main conspirator <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/david-coleman-headley\" target=\"_blank\" rel=\"noopener\">David Coleman Headley<\/a> alias Daood Gilani, a US citizen, has landed India after the US Supreme Court on April 4 dismissed his review plea against his extradition to India.<\/p>\n<p><!--\/dynamic_link.cms?msid=107107653&subsecid=1715249553&pos=toppotime:249-->Krishnan, who has been associated with the extradition proceedings since 2010, will have assistance from Special Prosecutor Narender Mann, a seasoned criminal lawyer, who has earlier represented the Central Bureau of Investigation in the Delhi High Court.<\/p>\n<p>The prosecution team will also comprise advocates Sanjeevi Sheshadri and Sridhar Kale aside from the NIA counsel, it is learnt.<\/p>\n<p><strong>ALSO READ: <\/strong><a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/news\/international\/world-news\/pakistan-says-it-has-nothing-to-do-with-canadian-national-tahawwur-rana\/articleshow\/120157323.cms\">Pakistan says it has nothing to do with &#8216;Canadian national&#8217; Tahawwur Rana<\/a><\/p>\n<p>The turning point in the extradition case came in May 2023. Rana&#8217;s trial had begun in 2018.<\/p>\n<div style=\"display:none;\" data-ga-impression=\"Events_widget_$pagename#Impression#url\" class=\"liveEventMain_widget custom_ad\">\n<div class=\"topContain\">\n<div class=\"imgBox\"><\/div>\n<h3 class=\"logoTitle\">Live Events<\/h3>\n<\/div>\n<\/div>\n<p><!--\/live_events_widget.cms?pagename=articlepotime:21--><br \/>Rana had arranged passports for fellow jihadi, Pakistani-American David Coleman Headley, aka Dawood Gilani, to travel to India to select targets for the terror attack that was being hatched by Lashkar in collaboration with ISI, Pakistan&#8217;s spy agency. Rana gloated over the deaths in Mumbai on Nov 26, 2008 and said that the jihadis responsible for it should be given Pakistan&#8217;s highest posthumous military honours, according to NIA.So far only <a ref=\"dofollow\" data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/ajmal-kasab\" target=\"_blank\" rel=\"noopener\">Ajmal Kasab<\/a>, the sole LeT terrorist involved in 26\/11 rampage who was nabbed alive, had been prosecuted.&#8221;The most important decision of his extradition came on May 16, 2023, being the first judgment by the Magistrate Judge, US District Court of Central District of California,&#8221; said a source close to the extradition proceedings.<\/p>\n<p>The Magistrate Court endorsed Krishnan&#8217;s position while approving the extradition, confirming that Rana&#8217;s situation did not constitute double jeopardy.<\/p>\n<p>The proceedings featured intense legal debates between Krishnan and extradition specialist Paul Garlick QC, who defended Rana.<\/p>\n<p>While Garlick maintained it was double jeopardy, Krishnan contended that the crime&#8217;s elements, not the accused&#8217;s behaviour, determined the circumstances.<\/p>\n<p>Double jeopardy refers to punishing someone twice for the same crime.<\/p>\n<p>The court accepted the arguments presented by Krishnan, who represented India&#8217;s government alongside the US department of justice.<\/p>\n<p>Another crucial victory came when a US District Judge dismissed Rana&#8217;s appeal on August 10, 2023.<\/p>\n<p>After this setback, Rana approached the US Court of Appeals 9th Circuit, but faced rejection on August 15, 2024, according to the source.<\/p>\n<p>Rana, aged 64 and a Canadian citizen born in Pakistan, then sought help from the US Supreme Court, which denied relief on January 21, 2025.<\/p>\n<p>Finally, on April 4, the US Supreme Court rejected Rana&#8217;s review petition, his last attempt to avoid extradition, the source noted.<\/p>\n<p>On November 26, 2008, a group of 10 Pakistani terrorists went on a rampage, carrying out a coordinated attack in Mumbai&#8217;s CST, two luxury hotels and a Jewish centre, after they sneaked into India&#8217;s financial capital using the sea route in the Arabian Sea.
