The West Bengal police<\/a> have filed a first information report (FIR<\/a>) naming Instagram<\/a> as a co-accused in an offence under Section 12<\/a> of the Protection of Children from Sexual Offences (POCSO) Act and Section 67 (B) of the Information Technology (IT) Act of 2000.<\/p>\n

The FIR was filed on April 11 at the cyber police station of Dakshin Dinajpur district of the state. ET has seen a copy of the FIR.<\/p>\n

The complaint was filed by the victim at the directions of the National Commission for Protection of Child Rights, the agency\u2019s chairperson Priyank Kanoongo told ET.<\/p>\n

Section 12 of the POCSO Act<\/a> says that a person who commits sexual harassment on a child may be imprisoned for up to three years along with a fine. The offence is non-bailable, according to rulings of various high courts in the country.<\/p>\n

Section 67 (B) of the IT Act meanwhile prescribes a punishment of up to five years with a fine of up to Rs 10 lakh in the first instance and a jail term of up to seven years and a similar fine in the second instance.<\/p>\n

Emails sent to Meta seeking their response on the issue did not yield any response.<\/p>\n

In October last year, the ministry of electronics and information technology issued notices to several social media platforms <\/a>warning them to remove child sexual abuse material (CSAM) from their platforms.The notices were sent a day after ET had then reached out to senior officials in the IT ministry seeking their comments about the presence of pornographic material and CSAM on social media platforms.<\/div>\n
