New Delhi: A special court<\/a> earlier this week framed charges<\/a> against former Rajya Sabha member Vijay Darda<\/a>, his son Devendra Darda<\/a>, industrialist Manoj Jayaswal<\/a> and others under relevant sections of Prevention of Money Laundering<\/a> Act (PMLA<\/a>) in connection with a coal allocation scandal.<\/p>\n

The court also framed charges against AMR Iron and Steel<\/a>, Asera Banka Power<\/a> and Abhishek Jayaswal<\/a> under Section 3 and 4 of PMLA.<\/p>\n

The court, however, discharged 15 of the total 21 co-accused in the case, finding no evidence to charge them. Of the 15 discharged, seven are Kolkata-based alleged shell companies controlled by a chartered accountant through six of his employees who were made directors in the alleged shell companies.<\/p>\n

The chartered accountant Santosh Jain<\/a>, his employees and companies were represented by advocate Vijay Agarwal. The 15 were accused of layering alleged bribe<\/a> amount of Rs 24.6 crore received from industrialist Manoj Jayaswal and his son Abhishek Jayaswal.<\/p>\n

ED<\/a> had alleged that the bribe was layered through a web of interconnected transactions before paying it to Asera Banka Power, a company controlled by former Rajya Sabha MP Vijay Darda and his son for their help in facilitating the allocation of Bander coal block to the company AMR Iron & Steel.<\/p>\n

It was alleged that the bribe amount was paid by masking it through a web of inter-related share-purchase transactions and by buying shares of the ultimate beneficiary Asera Banka at highly inflated figures.ED had launched a money laundering probe on the basis of an FIR registered by CBI<\/a> against AMR for having paid a bribe of Rs 26.4 crore for securing the allocation of Bander Coal Block situated in Maharashtra.It is alleged that Vijay Darda wrote several letters to the government seeking a recommendation in favour of AMR Iron & Steel while mentioning incorrect facts in those letters.<\/p>\n

Defence counsel Vijay Aggarwal argued that the directors of the Kolkata-based alleged shell companies were witnesses to the CBI’s case, where they admitted having facilitated these transactions, but later the ED went on to array them as accused for the same role played by them.<\/p>\n

Aggarwal further argued that a person can either be a witness to the crime or an accused, but they cannot be both. He further contended that the accused by virtue of being witnesses cannot be said to have knowledge of the criminal offence as they have merely witnessed it, whereas, having knowledge of the nature of the money one is dealing with is an essential ingredient to establish the offence of money laundering.<\/p>\n<\/div>\n
