Delhi Chief Minister Arvind Kejriwal<\/a>\u2019s aide, Bibhav Kumar<\/a>, has been sent to five days in police custody<\/a> following allegations of assaulting AAP<\/a> Rajya Sabha member Swati Maliwal<\/a>. The Delhi Police<\/a> arrested Kumar on Saturday, and his anticipatory bail plea was subsequently declared \u201cinfructuous\u201d by a Delhi court<\/a>.<\/p>\n

The police allege that Kumar, Kejriwal\u2019s personal assistant, assaulted Maliwal at the CM’s residence on the morning of May 13. Kumar was produced before Metropolitan Magistrate Gaurav Goyal<\/a>, who granted the police\u2019s request for custody.<\/p>\n

The police, through their counsel, sought seven days of custody to question Kumar about the assault<\/a>. They argued that Kumar did not provide his mobile phone password to the investigating agency and claimed that his phone had been formatted in Mumbai<\/a> due to a malfunction. Police stated, \u201cBefore being formatted, the data of a mobile phone has to be cloned, and Kumar was required to be taken to Mumbai for retrieving the data.\u201d They added that his presence was needed when his mobile phone is opened by an expert.<\/p>\n

Kumar\u2019s counsel, Rajiv Mohan, contested the police\u2019s claims, stating, \u201cNeither was there any record of Maliwal’s visit to the CM’s residence before May 13 nor did she clarify the reason for registering the FIR only on May 16.\u201d The FIR was filed at the Civil Lines police station<\/a>. Mohan noted that Maliwal visited the CM’s residence without an appointment and accused the police of distorting facts.<\/p>\n

Mohan also highlighted inconsistencies, saying, \u201cNeither did Maliwal seek any medical aid after calling the emergency helpline number 112<\/a> nor did the station house officer prepare any medical sheet after meeting her.\u201d He alleged<\/a> that Maliwal was politicizing the issue of having suffered injuries and was making media statements.<\/p>\n

Mohan argued that Kumar’s mobile phone was not required for the investigation<\/a> since Maliwal had not alleged any threats via phone or WhatsApp calls. He asserted, \u201cWhen the grounds of arrest are ‘not justified’, there is no question of police custody.\u201dAnother counsel for Kumar, Shadan Farasat, claimed that Kumar\u2019s lawyers were not provided a copy of the FIR, while it was circulated in the media. He suggested that Kumar was arrested<\/a> to undermine his anticipatory bail application.In response, the Delhi Police’s counsel stated that according to the FIR, Maliwal was “in shock” after being assaulted and lodged the complaint after recovering.
The court\u2019s decision to place Bibhav Kumar in police custody underscores the need for a detailed investigation into the alleged assault. As the investigation progresses, both sides continue to present conflicting narratives regarding the incident.<\/div>\n
