Prosecutor\u2019s Request for Warrants for Israeli and Hamas Leaders\" \/><\/div><p> <br \/>\n<\/p>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The prosecutor of the International Criminal Court said on Monday that he had requested arrest warrants for war crimes and crimes against humanity for Prime Minister Benjamin Netanyahu of Israel and the leaders of Hamas. Here\u2019s a closer look at the court and the warrant.<\/p>\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-37fffa1b\">Why did the International Criminal Court prosecutor request the warrants?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The court\u2019s prosecutor, Karim Khan, said in a statement that he was applying for arrest warrants for Yahya Sinwar, Mohammed Deif and Ismail Haniyeh of Hamas because he had \u201creasonable grounds to believe\u201d that they were responsible for war crimes and crimes against humanity, which included \u201cthe killing of hundreds of Israeli civilians\u201d in the Hamas-led Oct. 7 attacks in Israel, and the taking of at least 245 hostages.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Khan said that the Hamas officials \u201cplanned and instigated the commission of crimes\u201d on that day, and that they \u201chave acknowledged their responsibility for those crimes\u201d through their actions, such as personal visits to hostages shortly after their kidnapping.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Khan also said that he had requested arrest warrants for Mr. Netanyahu and Israel\u2019s defense minister, Yoav Gallant, because he believed they bore responsibility for war crimes and crimes against humanity, including the starvation of civilians as a weapon of war and \u201cintentionally directing attacks against a civilian population.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Khan said that these crimes were committed \u201cas part of a widespread and systematic attack against the Palestinian civilian population.\u201d He also said that in his office\u2019s view, some of the crimes \u201ccontinue to this day.\u201d<\/p>\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-6759fd86\">What is the International Criminal Court?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The International Criminal Court is the world\u2019s only permanent international court that can prosecute individuals accused of war crimes, genocide and crimes against humanity. It was established in 2002 to investigate those crimes under a 1998 treaty known as the Rome Statute. Before that, the United Nations Security Council had set up dedicated tribunals to address atrocities in places like the former Yugoslavia and Rwanda.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The I.C.C. is based in The Hague, a Dutch city that has long been a center for international law and justice. It is separate from the International Court of Justice, also an international tribunal in The Hague, which is currently assessing a claim brought by South Africa that Israel is <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/01\/12\/world\/middleeast\/israel-palestinians-icj-genocide.html\" title=\"\">conducting a genocide in Gaza<\/a>. Israel has strongly denied the accusation.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Many democracies joined the International Criminal Court, including close American allies like Britain. Israel is not a member of the court, and the United States has also long kept its distance, fearing that the court might one day try to prosecute American officials. Russia is also not a member.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Last year, the International Criminal Court <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/03\/17\/world\/europe\/putin-icc-arrest-warrant-war-crimes.html\" title=\"\">issued arrest warrants<\/a> for President Vladimir V. Putin and a second Russian official, saying they bore individual criminal responsibility for the abduction and deportation of Ukrainian children in the wake of Russia\u2019s full-scale invasion of Ukraine in 2022.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-55aa04c6\">What could the warrants mean for the officials?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Khan\u2019s request must still be approved by judges from the court. The fact that Israel is not a member of the court means that it does not recognize its jurisdiction in Israel or Gaza. But if warrants are issued, Mr. Netanyahu, Mr. Gallant and the Hamas officials could be arrested if they travel to one of the court\u2019s <a class=\"css-yywogo\" href=\"https:\/\/asp.icc-cpi.int\/states-parties\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">124 member nations<\/a>, which include most European countries.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The I.C.C. cannot <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/03\/17\/world\/europe\/putin-icc-arrest-warrant-war-crimes.html\" title=\"\">try defendants in absentia<\/a>, and has no police force, and it relies on its members to make the arrests. When arrested, suspects are typically transferred to The Hague to appear before the court.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Still, the warrant represents one of the harshest condemnations of Israel\u2019s strategy in its war against Hamas and its campaign\u2019s toll on Gaza\u2019s civilian population. It also adds scrutiny to Hamas\u2019s Oct. 7 raid that killed more than a thousand people.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">On Monday, Israel\u2019s foreign minister, Israel Katz, said that he had ordered the immediate establishment of a special committee aimed at fighting the decision, which he said \u201cwas intended first and foremost to tie the hands of the State of Israel and deny it the right of self-defense.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The \u201cscandalous\u201d prosecutor\u2019s decision, he said, \u201cis a frontal attack without restraint on the victims of Oct. 7 and our 128 hostages in Gaza.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a statement on Telegram, Hamas condemned the warrant requests against its leaders.
