Aam Aadmi Party<\/a>\u2019s Rajya Sabha MP<\/a> Sawti Maliwal on Monday broke down in Delhi\u2019s Tis Hazari Court<\/a> during the hearing of Delhi<\/a> CM Arvind Kejriwal<\/a>\u2019s aide Bibhav Kumar\u2019s bail plea case. <\/p>\n

Maliwal while addressing Delhi Court<\/a> said, “If the accused is released on bail, there would be a threat to me and my family.”<\/p>\n

After hearing arguments from both sides, the court denied Kumar’s bail <\/p>\n

Here are the top statements from the court:<\/strong>
Senior advocate N Hariharan argued in court that Swati Maliwal<\/a> trespassed into the Chief Minister’s residence and called Bibhav Kumar, who was not present at the time.<\/p>\n

He emphasized that entering the official residence of the CM without an appointment or prior notification constitutes trespassing. Security personnel stopped Maliwal, to which she retorted asking if they would keep an MP waiting, said Hariharan.<\/p>\n

She sat in the waiting room and asked security to talk to Kumar, the defence counsel submitted. <\/p>\n

\u201cWhat she is stating in the FIR, is not true and it was lodged after three days,\u201d Hariharan argued.<\/p>\n

Hariharan said that Maliwal could have been taken to any hospital in the area, but she was taken to AIIMS<\/a>, further arguing that there were no grievous injuries to vital parts, so there was no question of Culpable homicide not amounting to murder. <\/p>\n

Hariharan argued that the injuries can be \u201cself-inflicted.\u201d<\/p>\n

\u201cThis entire FIR is the result of afterthought,\u201d he argued. He added that he was seeking bail and not acquittal. <\/p>\n

\u201cEverything is pre-planned and tailor-made to suit her story, It was an overreach by the prosecution preventing this court from passing an order on anticipatory bail,\u201d he said. <\/p>\n

He said that CCTV footage is not tampered with CCTV as it has already been recovered.<\/p>\n

In reply, additional public prosecutor, representing Maliwal alleged that the accused went to Mumbai to format his phone. \u201cWe may ask for further police custody. I strongly opposed the bail application,\u201d APP submitted<\/p>\n

Advocate Madhav Khurana, counsel for Maliwal, referred to the judgement on whether he can address the court or not. He submitted that the victim has the right to be heard.<\/p>\n

\u201cBail application can’t be heard without issuing a notice to the victim,\u201d Khurana argued. \u201cAs per the MLC, the injuries were there even after four days, which shows the magnitude. Three-four days delay is inconsequential in these cases,\u201d her Advocate argued.<\/p>\n

\u201cThe accused was found at the place of occurrence, he was interrogated but was evasive in answering,\u201d Khurana said.<\/p>\n

He also submitted that the accused allegedly assaulted a public servant earlier. If the accused is innocent, then why format his phone, tempered the CCTV, file a complaint on May 17, Advocate Khurana said.<\/p>\n

Maliwal is receiving rape and murder threats, Khurana argued.<\/p>\n<\/div>\n
