The Delhi High Court<\/a> on Thursday rejected the Patient Safety and Access Initiative<\/a> of India Foundation<\/a>\u2019s plea seeking action against large scale illegal import<\/a> of high-end and high-value used medical equipment<\/a> other than critical care (Refurbished HEHV medical equipment) without following the mandatory regulations, including prior approval by the Ministry of Environment<\/a>, Forest and Climate Change.<\/p>\n

However, a Bench led by acting chief Justice Manmohan gave liberty to the Foundation, a not-for-profit organisation<\/a>, to file its representation before the concerned government authorities.<\/p>\n

Senior counsel Sandeep Sethi<\/a>, appearing for the NGO, sought returning of these items and further sought a penalty on Intuitive Surgical India Pvt Ltd<\/a> and Intuitive Surgical, Inc<\/a> for such illegal imports and for violating the rules and regulations.<\/p>\n

According to the petition, various hospitals were extensively advertising the introduction of robotic-assisted surgical systems<\/a> without disclosing that those products were used and second-hand.<\/p>\n

These imported products leave the patients at the mercy of substandard, obsolete and unreliable equipment which have been discarded in other countries, it said.<\/p>\n

The PIL filed by Karan Gupta, Partner, KGVS Legal LLP<\/a>, had relied on extensive data to illustrate that just one company itself had imported 845 items of such used robotic-assisted surgical systems, including its components and accessories worth Rs 250 crore since 2019.<\/div>\n
