against Sir Keir Starmer\u2019s leadership.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The action is estimated to have cost the party millions of pounds, which critics said could otherwise have been spent on the general election campaign.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The five included two key figures from the Jeremy Corbyn era \u2013  ex- director of communications Seumas Milne and Mr Corbyn\u2019s former chief of staff Karie Murphy.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">They were accused of leaking a controversial report soon after Sir Keir became the Labour leader in 2020.<!-- --><\/p>\n<\/div>\n<p><h2 class=\"sc-518485e5-0 kRvAla\">&#8216;Eye-watering sums&#8217;<!-- --><\/h2>\n<\/p>\n<div data-component=\"text-block\" class=\"sc-43e6b7ba-0 bWSguZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">A former shadow cabinet member \u2013 who did not wish to identified \u2013 told the BBC the party should have dropped the legal action earlier.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">He said: &#8220;This is a huge embarrassment for the party, which has wasted eye-watering sums which could have made the difference in key seats in this election.&#8221;<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Labour had said previously it had been confident of its case.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The most recent documents presented in open court last autumn showed that Labour had spent \u00a31.5m on legal action, and estimated it would spend nearly \u00a3900,000 more.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The party&#8217;s final costs are likely to be higher, as these figures don\u2019t reflect the full cost of the litigation.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">But it\u2019s not clear if the party will meet the costs of those it claimed had leaked the controversial report. <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">In a statement to the court, Labour officials claimed that the five &#8220;entered into a conspiracy to use unlawful means\u2026 to provide a copy (or copies) of the Report to the press&#8221; to damage the party &#8220;under the leadership of its then new leader, Keir Starmer&#8221;.<!-- --><\/p>\n<\/div>\n<figure>\n<div data-component=\"image-block\" class=\"sc-43e6b7ba-0 dOZXmm\">\n<div data-testid=\"image\" class=\"sc-fd6cb93-1 hXQtlW\"><img decoding=\"async\" sizes=\"(min-width: 1280px) 50vw, (min-width: 1008px) 66vw, 96vw\" srcset=\"https:\/\/ichef.bbci.co.uk\/news\/240\/cpsprodpb\/4136\/live\/f322b770-2371-11ef-907e-91a8d78624bf.jpg.webp 240w,https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/4136\/live\/f322b770-2371-11ef-907e-91a8d78624bf.jpg.webp 320w,https:\/\/ichef.bbci.co.uk\/news\/480\/cpsprodpb\/4136\/live\/f322b770-2371-11ef-907e-91a8d78624bf.jpg.webp 480w,https:\/\/ichef.bbci.co.uk\/news\/640\/cpsprodpb\/4136\/live\/f322b770-2371-11ef-907e-91a8d78624bf.jpg.webp 640w,https:\/\/ichef.bbci.co.uk\/news\/800\/cpsprodpb\/4136\/live\/f322b770-2371-11ef-907e-91a8d78624bf.jpg.webp 800w,https:\/\/ichef.bbci.co.uk\/news\/1024\/cpsprodpb\/4136\/live\/f322b770-2371-11ef-907e-91a8d78624bf.jpg.webp 1024w,https:\/\/ichef.bbci.co.uk\/news\/1536\/cpsprodpb\/4136\/live\/f322b770-2371-11ef-907e-91a8d78624bf.jpg.webp 1536w\" src=\"https:\/\/ichef.bbci.co.uk\/news\/480\/cpsprodpb\/4136\/live\/f322b770-2371-11ef-907e-91a8d78624bf.jpg.webp\" loading=\"lazy\" alt=\"Reuters Jeremy Corbyn and Keir Starmer\" class=\"sc-fd6cb93-0 hvRJnO\"\/><span class=\"sc-fd6cb93-2 iuQLaK\">Reuters<\/span><\/div>\n<\/div>\n<p><figcaption class=\"sc-8353772e-0 cvNhQw\">Jeremy Corbyn and Keir Starmer on the campaign trail in 2019<!-- --><\/figcaption><\/p>\n<\/figure>\n<div data-component=\"text-block\" class=\"sc-43e6b7ba-0 bWSguZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Through their lawyers, the five had &#8220;strenuously denied, and have consistently denied, any involvement or complicity in the leak whatsoever&#8221;.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">A very senior official in the party previously described the legal action to the BBC as a &#8220;gamble&#8221;.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">And concerns had been raised privately about pursuing it by some Starmer supporters who were no fans of the Corbyn leadership.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The 860 page leaked document ostensibly examined the handling of antisemitism complaints under Mr Corbyn\u2019s leadership.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">But it was a lot more than that. <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-politics-52271317\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">report&#8217;s contention was that anti-Corbyn staffers<!-- --><\/a> had impeded progress on antisemitism complaints, and it suggested some of them had diverted funds away from certain constituencies in the closely-fought 2017 election which the party needed to win. <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">But perhaps the most controversial aspect was the inclusion of unredacted emails and WhatsApp messages from Corbyn critics, which laid bare internal tensions and factionalism.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Some of the messages contained derogatory comments about pro-Corbyn MPs and staff.<!-- --><\/p>\n<\/div>\n<p><h2 class=\"sc-518485e5-0 kRvAla\">Mounting costs<!-- --><\/h2>\n<\/p>\n<div data-component=\"text-block\" class=\"sc-43e6b7ba-0 bWSguZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">A <!-- --><a target=\"_blank\" href=\"https:\/\/labour.org.uk\/resources\/the-forde-report\/\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">subsequent report<!-- --><\/a> into the leak and the wider culture in the party by Martin Forde KC found, for example, \u2018the criticisms of Diane Abbott are not simply a harsh response to perceived poor performance \u2013 they are expressions of visceral disgust&#8221;.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The report had been intended as a submission to the Equality and Human Rights Commission (EHRC), which was, at the time, in the process of completing what would be <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-politics-54731222\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">a highly-critical report of the party\u2019s response<!-- --><\/a> to complaints of antisemitism during the Corbyn leadership.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Following legal advice, the party\u2019s then general secretary Jennie Formby did not submit the document to the EHRC and decided it should not be made public,  but it was leaked early in April 2020, within a week of Starmer becoming party leader.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Even though the party was under new management following Starmer\u2019s election as leader, it faced legal action from nine people &#8211; most of whom had made anti-semitism complaints &#8211; who said their privacy and data had been breached.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Labour named the five it considered responsible, including three more ex-staffers &#8211; to brief &#8220;a narrative\u2019 of the document to the press &#8211; with any confidential information redacted \u2013 but only in the event it was submitted to the EHRC, which never happened.  <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">None of the five, their lawyers said, had considered  the disclosure of the full unredacted report and they had condemned the leaking of the full document as &#8220;reckless and foolish&#8221; and not politically sensible.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Perhaps more significantly, three inquiries or investigations into the leak had been conducted. The party itself appointed an independent investigator, Morag Slater, whose report was unable to name the leakers.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The  wide-ranging Forde report in to the party\u2019s culture <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-politics-62226042\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">concluded in 2022<!-- --><\/a>: &#8220;We could not identify the source of the leak.&#8221;<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">And the Information Commissioners Office &#8211; the UK\u2019s data watchdog &#8211; <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-politics-64248136\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">told the BBC 18 months ago<!-- --><\/a> that it had found &#8220;insufficient evidence&#8221; that &#8220;any individual had unlawfully obtained or disclosed personal data&#8221;.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">A joint statement from Labour and from lawyers for the five states: &#8220;The party is discontinuing its legal claims against Karie Murphy, Seumas Milne, Georgie Robertson, Harry Hayball and Laura Murray on a \u2018no order as to costs\u2019 basis.
