The key investigator<\/a> at the antitrust regulator<\/a> will get more time to submit the probe report<\/a> in cases where the watchdog finds a prima facie violation of competition norms<\/a>, according to the draft amendments<\/a> to the Competition Commission of India (CCI<\/a>) General Regulations<\/a>, 2009.The director general of investigation at the CCI will get up to 90 days to file the report under ordinary circumstances, against the current 60 days, the draft amendments, floated by the regulator, have proposed.<\/p>\n

The move is aimed at facilitating a more thorough probe of the cases by the DG<\/a>, especially in emerging areas of the economy<\/a> where investigating antitrust norm violations<\/a> involve a rigorous process.<\/p>\n

Of course, the draft amendments propose to retain the extant provision that enables the regulator to grant even more time \u201cas it may consider reasonable\u201d on an application made by the director general, giving sufficient reasons. <\/p>\n

Where the CCI believes that a prima facie case exists, its secretary will \u201cconvey the directions of the Commission within seven days to the director general to investigate the matter\u201d.<\/p>\n

The draft regulations also propose to rope in agencies to monitor implementations of settlement and commitment offered by companies, including digital players, in antitrust cases.<\/p>\n

The draft amendments are aimed at revamping the Competition Commission of India (General) Regulations, 2009, to align them with the last year’s changes to the competition law, among others.<\/p>\n

Stakeholders are asked to submit their comments on the draft regulations by July 8.<\/p>\n

Misconduct by advocates<\/h2>\n

Interestingly, the draft amendments propose to scrap an existing provision relating to the misconduct of the advocate who accompanies the person summoned by the DG.<\/p>\n

The extant regulations say: \u201cIn case of any misconduct (by the advocate), the DG for reasons to be recorded in writing shall forward a complaint to the Commission. The Commission, if satisfied with the complaint of the DG, may pass necessary order debarring the advocate, guilty of misconduct, from appearing in the proceedings before the DG as well as before the Commission in future or till such time as the Commission deems necessary.\u201d
