You then get automatically billed.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">However, back in April it was widely reported that rather than solely using AI, Just Walk Out needed around 1,000 workers in India to <!-- --><a target=\"_blank\" href=\"https:\/\/www.theverge.com\/2024\/4\/17\/24133029\/amazon-just-walk-out-cashierless-ai-india\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">manually check almost three quarters of the transactions.<!-- --><\/a><\/p>\n<\/div>\n<div data-component=\"text-block\" class=\"sc-43e6b7ba-0 bWSguZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Amazon was quick to claim that <!-- --><a target=\"_blank\" href=\"https:\/\/www.aboutamazon.com\/news\/retail\/amazon-just-walk-out-dash-cart-grocery-shopping-checkout-stores\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">the reports were \u201cerroneous\u201d,<!-- --><\/a> and that staff in India were not reviewing video footage from all the shops.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Instead it said that the Indian workers were simply reviewing the system. Amazon added that \u201cthis is no different than any other AI system that places a high value on accuracy, where human reviewers are common\u201d.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">However, Amazon also confirmed that it would be reducing the number of stores that used the Just Walk Out system.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Whatever the exact details of the Amazon case, it is a high-profile example of a new and growing question \u2013 whether companies are making over-inflated claims about their use of AI. It is a phenomenon that has been dubbed \u201cAI washing\u201d in reference to the environmental &#8220;green washing&#8221;.<!-- --><\/p>\n<\/div>\n<div data-component=\"text-block\" class=\"sc-43e6b7ba-0 bWSguZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">But first, a reminder of what exactly AI means. While there is no exact definition, AI allows computers <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/technology-65855333\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">to learn and solve problems<!-- --><\/a>. AI is able to do this after first being trained on huge amounts of information.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The specific type of AI that has made all the headlines over the past few years is so-called &#8220;generative AI&#8221;. This is AI that specialises in creating new content, be it having text conversations, or producing music or images.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Chatbots like ChatGPT, Google&#8217;s Gemini, and Microsoft&#8217;s Copilot are popular examples of generative AI.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">When it comes to AI washing, there are several types. Some companies claim to use AI when they&#8217;re actually using less-sophisticated computing, while others overstate the efficacy of their AI over existing techniques, or suggest that their AI solutions are fully operational when they are not.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Meanwhile, other firms are simply bolting an AI chatbot onto their existing non-AI operating software.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">While only 10% of tech start-ups mentioned using AI in their pitches in 2022, this rose to more than a quarter in 2023, according to OpenOcean, a UK and Finland-based investment fund for new tech firms. In a 2019 study it found that 40% of new tech firms that described themselves as &#8220;AI start-ups&#8221; in fact <!-- --><a target=\"_blank\" href=\"https:\/\/mmc.vc\/wp-content\/uploads\/2024\/01\/The-MMC-State-of-AI-2019-Report.pdf\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">used virtually no AI at all.<!-- --><\/a><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">&#8220;The problem is the same today, plus a different problem,&#8221; says Simon Menashy, general partner at MMC Ventures.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">He explains that &#8220;cutting-edge AI capabilities&#8221; are now available for every company to buy for the price of standard software. But that instead of building a whole AI system, he says many firms are simply popping a chatbot interface on top of a non-AI product.<!-- --><\/p>\n<\/div>\n<div data-component=\"text-block\" class=\"sc-43e6b7ba-0 bWSguZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Dougal Dick, UK head of emerging technology risk at accountancy giant KPMG, says the problem of AI washing is not helped by the fact there not a single agreed definition of AI.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">&#8220;If I asked a room of people what their definition of AI is, they would all give a different answer,\u201d he says. \u201cThe term is used very broadly and loosely, without any clear point of reference. It is this ambiguity that is allowing AI washing to emerge.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">&#8220;AI washing can have concerning impacts for businesses, from overpaying for technology and services to failing to meet operational objectives the AI was expected to help them achieve.&#8221;<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Meanwhile, for investors it can make it harder to identify genuinely innovative companies.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">And, says Mr Ayangar: &#8220;If consumers have unmet expectations from products that claim to offer advanced AI-driven solutions, this can erode trust in start-ups that are doing genuinely ground-breaking work.&#8221;<!-- --><\/p>\n<\/div>\n<div data-component=\"text-block\" class=\"sc-43e6b7ba-0 bWSguZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Regulators, in the US at least, are starting to take notice. Earlier this year, the US Securities and Exchange Commission (SEC) said it was <!-- --><a target=\"_blank\" href=\"https:\/\/www.sec.gov\/news\/press-release\/2024-36\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">charging two investment advisory firms<!-- --><\/a> with making false and misleading statements about the extent of their use of AI.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">&#8220;The firm stance taken by the SEC demonstrates a lack of leeway when it comes to AI washing, indicating that, at least in the US, we can expect more fines and sanctions down the line for those who violate the regulations,&#8221; says Nick White, partner at international law firm Charles Russell Speechlys.<!-- --><\/p>\n<\/div>\n<figure>\n<div data-component=\"image-block\" class=\"sc-43e6b7ba-0 dOZXmm\">\n<div data-testid=\"image\" class=\"sc-13b8515c-1 bbjeKz\"><img decoding=\"async\" src=\"https:\/\/www.bbc.com\/bbcx\/grey-placeholder.png\" class=\"sc-13b8515c-0 WTpgI hide-when-no-script\"\/><img decoding=\"async\" sizes=\"(min-width: 1280px) 50vw, (min-width: 1008px) 66vw, 96vw\" srcset=\"https:\/\/ichef.bbci.co.uk\/news\/240\/cpsprodpb\/5a21\/live\/68a2e4e0-3379-11ef-9fb3-db4b10d023b6.jpg.webp 240w,https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/5a21\/live\/68a2e4e0-3379-11ef-9fb3-db4b10d023b6.jpg.webp 320w,https:\/\/ichef.bbci.co.uk\/news\/480\/cpsprodpb\/5a21\/live\/68a2e4e0-3379-11ef-9fb3-db4b10d023b6.jpg.webp 480w,https:\/\/ichef.bbci.co.uk\/news\/640\/cpsprodpb\/5a21\/live\/68a2e4e0-3379-11ef-9fb3-db4b10d023b6.jpg.webp 640w,https:\/\/ichef.bbci.co.uk\/news\/800\/cpsprodpb\/5a21\/live\/68a2e4e0-3379-11ef-9fb3-db4b10d023b6.jpg.webp 800w,https:\/\/ichef.bbci.co.uk\/news\/1024\/cpsprodpb\/5a21\/live\/68a2e4e0-3379-11ef-9fb3-db4b10d023b6.jpg.webp 1024w,https:\/\/ichef.bbci.co.uk\/news\/1536\/cpsprodpb\/5a21\/live\/68a2e4e0-3379-11ef-9fb3-db4b10d023b6.jpg.webp 1536w\" src=\"https:\/\/ichef.bbci.co.uk\/news\/480\/cpsprodpb\/5a21\/live\/68a2e4e0-3379-11ef-9fb3-db4b10d023b6.jpg.webp\" loading=\"lazy\" alt=\"Nick White Nick White\" class=\"sc-13b8515c-0 hbOWRP\"\/><span class=\"sc-13b8515c-2 iuvLSH\">Nick White<\/span><\/div>\n<\/div>\n<p><figcaption class=\"sc-8353772e-0 cvNhQw\">Nick White says that it is good to see US regulators clamping down on the problem<!-- --><\/figcaption><\/p>\n<\/figure>\n<div data-component=\"text-block\" class=\"sc-43e6b7ba-0 bWSguZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">In the UK, rules and laws covering AI washing are already in place, including the Advertising Standards Authority&#8217;s (ASA&#8217;s) code of conduct, which states that marketing communications must not materially mislead, or be likely to do so.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Michael Cordeaux, associate in the regulatory team at UK corporate law firm Walker Morris, says that AI claims have become an increasingly common feature of advertisements subject to ASA investigation.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Examples include a paid-for Instagram post about an app captioned &#8220;Enhance your Photos with AI&#8221;, which was held by the ASA to be <!-- --><a target=\"_blank\" href=\"https:\/\/www.asa.org.uk\/rulings\/codeway-dijital-hizmetler-anonim-sirketi-a23-1197999-codeway-dijital-hizmetler-anonim-sirketi.html\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">exaggerating<!-- --><\/a> the performance of the app, and was therefore misleading.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">&#8220;What is clear is that AI claims are becoming increasingly prevalent and, presumably, effective at piquing consumer interest,&#8221; says Mr Cordeaux.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cIn my opinion we are at the peak of the AI hype cycle,\u201d says Sandra Wachter, a professor of technology and regulation at Oxford University, and a leading global expert on AI.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cHowever, I feel that we have forgotten to ask if it always makes sense to use AI for all types of tasks. I remember seeing advertisements in the London Tube for electric toothbrushes that are powered by AI. Who is this for? Who is helped by this?&#8221;<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Also, the environmental impact of AI is often glossed over, she says.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cAI does not grow on trees\u2026 the technology already contributes more to climate change than aviation.
