Sibal urged the CJI to take an immediate call in this regard. &#8220;I will take a call&#8230; when I form the Constitution benches,&#8221; the CJI responded.<\/p>\n<p>Congress welcomed the <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> agreeing to consider setting up a separate bench to hear pleas against legislations, done by naming many contentious bills including the one on Aadhaar, as money bills. The Opposition party hoped that a definite conclusion on the matter would come before the term of the current CJI ends.<\/p>\n<p>Commenting on the matter on X, Jairam Ramesh, AICC communication in-charge said: &#8220;In the last ten years, many Bills have been bulldozed through Parliament by having them declared as &#8216;money bills&#8217; under Article 110 of the Constitution. A good example of this is the <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/aadhaar-act\" target=\"_blank\" rel=\"noopener\">Aadhaar Act<\/a> of 2016. I had challenged its declaration as a money bill in the Supreme Court, and in his dissenting judgement then, the present CJI had called this declaration as a &#8216;fraud on the Constitution&#8217;. I had challenged other instances as well. The verdict of the CJI today to set up a separate constitutional bench to hear pleas on the gross misuse of Article 110 since 2014 is a welcome step. Hopefully, a final and definitive pronouncement will come before he retires in Nov 2024.&#8221;<\/p>\n<p>A money bill is a piece of legislation which can be introduced only in the Lok Sabha and the <a data-ga-onclick=\"Inarticle articleshow link click#News#href\" href=\"https:\/\/economictimes.indiatimes.com\/topic\/rajya-sabha\" target=\"_blank\" rel=\"noopener\">Rajya Sabha<\/a> cannot amend or reject it. The Upper House can only make recommendations which may or may not be accepted by the Lower House. Last October, SC had said it would constitute a seven-judge bench to consider the issue of validity of passage of laws such as the Aadhaar Act as a money bill.
