Priti Patel, Britain\u2019s home secretary at the time, approved <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/06\/17\/world\/europe\/assange-extradition.html\" title=\"\">the extradition<\/a>. Last month, two High Court judges heard Mr. Assange\u2019s final bid for an appeal. The judges are expected to hand down a written decision at 10:30 a.m. local time (6:30 a.m. Eastern) on Tuesday.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Here are the most likely scenarios.<\/p>\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-63f7d0d2\">Mr. Assange is allowed to appeal.<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">In this case, Mr. Assange would be allowed to have a full appeals case heard in front of the British court on new grounds. That could open the door to a new decision about his extradition.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">This would mean that the legal case, which has caught the world\u2019s attention and mobilized defenders of press freedom, will continue to be disputed, and that Mr. Assange\u2019s removal to the United States will at least be delayed.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The extradition order was initially denied by a British judge in 2021, who <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/01\/04\/world\/europe\/assange-extradition-denied.html\" title=\"\">ruled that Mr. Assange was at risk of suicide<\/a> if sent to a U.S. prison. Britain\u2019s High Court later reversed that decision after U.S. officials issued reassurances about his treatment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A <a class=\"css-yywogo\" href=\"https:\/\/rsf.org\/en\/uk-julian-assange-dangerously-close-extradition-following-high-court-rejection-appeal\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">lower-court judge denied Mr. Assange\u2019s request to appeal<\/a> the extradition order, and his lawyers asked the High Court to overturn that move.<\/p>\n<h2 class=\"css-9ycfei eoo0vm40\" id=\"link-fd92e6a\">His request is denied.<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Assange could be put on a plane bound for the United States, his lawyers have said, potentially ending his yearslong battle.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But Mr. Assange\u2019s legal team has vowed to challenge an affirmative extradition decision to the European Court of Human Rights in Strasbourg, France. Britain is compelled to comply with the court\u2019s judgment as a signatory to the <a class=\"css-yywogo\" href=\"https:\/\/www.amnesty.org.uk\/what-is-the-european-convention-on-human-rights\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">European Convention on Human Rights<\/a>. A challenge in the court could potentially pause his extradition until the case is heard in Strasbourg.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div>\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Assange was indicted in 2019 in Northern Virginia on <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2019\/04\/11\/world\/europe\/julian-assange-wikileaks-ecuador-embassy.html\" title=\"\">a federal charge<\/a> of conspiring to hack into a Pentagon computer network in 2010. Then he was indicted <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2019\/05\/23\/us\/politics\/assange-indictment.html\" title=\"\">on 17 counts of violating the Espionage Act<\/a> for his role in obtaining and publishing the secret military and diplomatic documents.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The accusations could bring a sentence of up to 175 years in prison on conviction, said his lawyers, who have described the charges as politically motivated. But lawyers for the U.S. government, which has said that the leaks put lives at risk, have said that Mr. Assange is more likely to be given a shorter sentence of four to six years.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Alice Jill Edwards, the United Nations special rapporteur on torture, has said that if he were extradited, Mr. Assange would be at risk of treatment amounting to torture or other forms of punishment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a statement last month, she said that Mr. Assange could face \u201cprolonged solitary confinement, despite his precarious mental health status, and to receive a potentially disproportionate sentence.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">American officials previously gave assurances that he would not be held in the United States\u2019 highest-security prison and that, if convicted, he could serve his sentence in his native Australia.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But Ms. Edwards has said that those assurances are \u201cnot a sufficient guarantee.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Two British judges are set to decide on Tuesday whether Julian Assange, the WikiLeaks founder, will be granted the right to appeal an extradition order to the United States, where he is facing charges under the Espionage Act.
