Supreme Court hauls up CBI for alleging ‘all West Bengal courts have hostile environment’


New Delhi: The Supreme Court on Friday hauled up Central Bureau of Investigation for making “scandalous allegations” in its plea against courts in West Bengal while seeking that the 2021 post-poll violence cases be heard outside the state.

A bench of justices Abhay S Oka and Pankaj Mithal strongly disapproved of CBI’s plea.

The bench observed that the agency’s plea was attempting to cast aspersions on the entire judiciary of West Bengal by suggesting that a “hostile environment” existed in all West Bengal courts.

Taking strong exception to this, the top court verbally remarked, “You are brandishing all courts in West Bengal as hostile. Judges of the district judiciary cannot protect themselves. You are saying that trials are not conducted properly”.

The counsel for the agency conceded that the petition contained “loose drafting” and offered to amend it. The bench, however, insisted on its withdrawal. Following the reprimand, the agency withdrew its plea.


“Scandalous allegations have been made against all the courts in general in West Bengal. Repeatedly averred that there is a hostile environment prevailing in the courts. It is very unfortunate that the central agency has chosen to cast aspersions on courts in West Bengal,” the top court said in its order.The bench found it troubling that CBI had chosen to challenge the integrity of the state’s judiciary. In December last year, CBI had filed a plea to transfer these cases, expressing concern about potential witness intimidation.
