Supreme Court gets 12 pleas against Waqf Act; CJI Sanjiv Khanna to consider urgent listing

A Supreme Court bench headed by Chief Justice of India (CJI) Sanjiv Khanna Monday said it would consider the request for urgent listing of pleas challenging the Waqf (Amendment) Act, 2025.

Senior advocate Kapil Sibal on behalf of Jamiat Ulama-i-Hind, one of the petitioners, mentioned the matter seeking urgent listing before the bench on Monday morning. Senior advocate Abhishek Manu Singhvi and advocate Nizam Pasha also appeared for other petitioners.

Nearly a dozen petitions have been filed in the top court challenging the Act. Some of the petitioners include AIMIM MP Asaduddin Owaisi, Congress MP Mohammad Jawed, Delhi AAP MLA Amanatullah Khan, Jamiat Ulema-i-Hind president Maulana Arshad Madani, Samastha Kerala Jamiatul Ulema, Indian Union Muslim League and Association for Protection of Civil Rights.

Dravida Munnetra Kazhagam (DMK) has also filed a plea in the top court challenging the Act. The petition has been filed through DMK’s deputy general secretary and Lok Sabha MP A Raja, who was also a member of the joint parliamentary committee on the Waqf bill.

The plea contends that the Act violates the fundamental rights of about 5 million Muslims in Tamil Nadu and 200 million Muslims in other parts of the country. On March 27, the Tamil Nadu Legislative Assembly had passed a resolution urging the union government to withdraw the Waqf amendment bill.


The DMK has contended that the Act was passed without considering the serious objections raised by its members both in the JPC as well as during the discussion in the Parliament.
